Simply put, our terms of use are: "You own your own words." Or images, as the case may be. This policy originated with Stewart Brand on The WELL in the 1980s and, with adaptations, has stood the test of time for online communities.

Your Rights and Responsibilities

"You own your own words." Since most words will be in the form of comments on images, we moderate all comments. Please engage us in good faith, however critical you may be. If you troll us, your comments will not be approved. There is no appeal.

By uploading your images on take-note.com, you agree to publish them on the internet, and to distribute them in ways that take-note.com deems appropriate (on social networks, for example). By default, you retain the copyright for your images, and the default licensing of use is determined by a Creative Commons license.  As you publish each of your images on take-note.com, you have the opportunity to change copyright and licensing from the site defaults.

You agree to provide your real full name and email address when signing up as a take-note.com member. By providing an email address during registration, you "opt-in" to receive emails from take-note.com. take-note.com normally does not permit anonymous or pseudonymous accounts. Exceptions to this general rule require special arrangements with the management of take-note.com.

If you have a complaint about the behavior or posts of another member, it is your responsibility to attempt to resolve the conflict, typically by contacting that person directly. Normally, the take-note.com management will not take a role in mediating conflicts between you and other members. take-note.com does not take responsibility for your behavior or that of other members of the system. However, a take-note.com member has the right to expect not to be bothered by others against his or her will. As noted in the first paragraph, we will protect this community from internet trolls.

Your access to the works that members have posted on take-note.com is for your use only, unless otherwise permitted by the author. Typically, the author will indicate permitted use of their images in the copyright and licensing information directly associated with the image.  If you want to redistribute works you find on take-note.com, it is your responsibility to obtain permission from the author (and any other person with rights in the material). 

You are legally and ethically responsible for any works—writings, files, pictures, or any other work—that you post or transmit using any take-note.com service: email, private messaging, forums, blogs, chats, the World Wide Web, or any other service that allows interaction or dissemination of information, such as Facebook functions that appear on this service. In posting works on take-note.com, you are responsible for honoring the rights of others, including intellectual property rights (copyright, patent, and trademark), the right to privacy, and the right not to be libeled or slandered.

Under United States law, you retain copyright on all works you create and post to take-note.com unless you choose specifically to renounce it. In posting a work on a service offered by take-note.com, you authorize other members who have access to that service to make personal and customary use of the work, including creating links to or reposting among take-note.com-only content areas to which the author has access, but not otherwise to reproduce or disseminate it unless you give permission for such dissemination. You also give permission to take-note.com to copy your works as part of the normal backup process (which may include on-site and off-site backups). You have the right to remove any of your works from take-note.com at any time.

You agree to help protect your account and the security of other members by guarding your password. You take responsibility for all authorized use of your take-note.com account, and for all contributions to any service offered by take-note.com that you post from your take-note.com account. If you have reason to believe your password has been compromised or there has been any unauthorized use of your account, contact the take-note.com management as soon as possible.

You agree not to use the system for illegal activity or for violating the privacy or security of other members. Illegal activity under the laws of Montana and the United States using your take-note.com account is a violation of this agreement. Since the law as to jurisdiction of online communities is emerging, we urge you to consider the possible effect of laws outside the take-note.com's locality or your own residence. take-note.com is open to members worldwide (and works published on the World Wide Web or other such services are accessible to anyone on the internet), and take-note.com cannot guarantee that you won't run into legal trouble from other jurisdictions over your works.

You agree to not post commercial advertisements anywhere on take-note.com, except a link to your commercial site, if you have one, on your take-note.com home page, provided free to all members upon registration.

You may cancel your account at any time by contacting the take-note.com management.

By using take-note.com, whether you login to an account or not, you agree to these rights and responsibilities.

Our Rights and Responsibilities

take-note.com is not the publisher or author of any works posted by its members. It is a passive service for storage and dissemination of the works that take-note.com members may choose to post and distribute via take-note.com. take-note.com disclaims all copyright and ownership in such works and all responsibility for them.

Although it cannot make an absolute guarantee of system security, take-note.com takes reasonable steps to maintain security. By uploading an image to take-note.com you agree that the uploaded image is a copy of the original. If you have reason to believe system security has been breached, contact the take-note.com management for help.

If the take-note.com management finds that files or processes belonging to a member pose a threat to the proper technical operation of the system or to the security of other members, the take-note.com management reserves the right to delete those files or to stop those processes. If the take-note.com management suspects an account is being used by someone who is not authorized by the account holder, the take-note.com management may temporarily disable that account in order to preserve system security. In all such cases, the take-note.com management will contact the member as soon as feasible.

take-note.com reserves the right to refuse service to anyone and to cancel an account at any time.

take-note.com is provided "as is" without warranty of any kind. take-note.com will not be liable for incidental or consequential damages at all.

take-note.com reserves the right to change the terms of this Terms of Use statement without notice at any time.

take-note.com may assign and delegate its rights and obligations to any successor to all or part of its business or assets.

We encourage you to comment on our posts and to actively and critically engage with us and each other about posted content. Please note that all comments are moderated. If you troll us (i.e., you obviously do not support our mission or community), your comments will not be made public. If you persist, we will take action to block you from commenting.
